Terms and Conditions
Thank you for coming to the [University of Southern California’s Patient Experience Site] (the “Site”). These Terms and Conditions (“Terms”) constitute a binding agreement and are intended to eliminate any misunderstandings regarding the terms of your participation and use of the Site. By accessing, browsing, or inputting information into the Site, you agree to be bound by these Terms. If you do not agree to these Terms, then you must not use this Site.
USC may at any time revise these Terms and will post revised Terms here. Your continued use of the Site following the posting of a change will confirm your acceptance of the change, so please be sure to review these Terms regularly.
Of course, this site is not the place to seek medical care. Call your medical provider if you are experiencing symptoms that you want to report or dial 9-1-1 in case of emergency.
You represent and warrant that you are at least eighteen (18) years old and that you possess the legal ability to enter into these Terms.
Information You Submit. You, and not USC, are entirely responsible for all content that you submit via the Site. You represent that you are the sole author of any material you submit on the Site. You grant USC a perpetual, non-exclusive, world-wide, royalty-free, sublicensable license to any content you submit to the Site, which includes the right for USC or any other party it designates, to use, copy, transmit, excerpt, publish, distribute, publicly display, create derivative works of, host, index, cache, tag, encode, modify or adapt (including without limitation the right to adapt to streaming, downloading, broadcast, mobile, digital, thumbnail, scanning or other technologies) in any form or media now known or hereinafter developed.
Content that, in the sole and absolute judgment of USC, contains any of the following elements is strictly prohibited and you represent and warrant that you will not upload to the Site any of the following:
Language or statements that are libelous, defamatory, false, inaccurate, outdated, obscene, indecent, lewd, violent, abusive, threatening, harassing, discriminatory, unlawful, slanderous, hateful, or damaging to others.
- Confidential information, including any other person’s or institution’s confidential health information.
Information or content that could violate federal, state or local laws or regulations.
- Material that infringes on the personal or proprietary rights of any third party, including intellectual property, privacy or publicity rights.
Malware, viruses or any other similar software that might adversely affect the Site, USC, or other users of the Site.
Intellectual Property Rights. The trademarks, logos, and service marks (collectively the “Trademarks”) displayed on the Site are registered and unregistered Trademarks used by USC. Other data and content on this Site may be protected by patent, copyright and other laws. Nothing contained on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any content, Trademarks or other intellectual property displayed on the Site without the written permission of USC.
Contacting You. USC will ask you on this Site for your email address and possibly other information as a way of contacting you. Your submission of such information to USC constitutes permission for USC to contact you subsequently.
Indemnification. You agree to indemnify and hold USC, its officers, directors, faculty, employees, agents, or service providers harmless from any third party claims, damages, losses, liabilities, judgments, costs or expenses (including reasonable attorneys’ fees) relating to any material you have submitted.
Arbitration. All disputes arising under or in connection with these Terms of Service or the Site shall be submitted to JAMS or successor organization for binding arbitration in Los Angeles County. Such dispute shall be governed by California law. To the maximum extent permitted by law, in no event will the USC or its officers, directors, faculty, employees, agents or service providers be responsible for any incidental damages, consequential damages, exemplary damages of any kind, lost goodwill, lost profits, lost business and/or any indirect economic damages whatsoever in any way arising from or connected to the Site or these Terms.
